General Terms and Conditions of Trotti.ch AG

  1. Scope

The following general terms and conditions regulate the contractual relationship between Trotti.ch AG, hereinafter referred to as Trotti, and its customers. With the conclusion of a contract such as the transmission of an order and its confirmation by Trotti, the customer expressly accepts Trotti's terms and conditions as part of the contract.

  1. Service overview

Trotti is a trading company and deals in products, mainly in the field of electrically powered vehicles. Trotti products and services are described in the applicable brochures and in the online shop and can be changed by Trotti at any time.

The delivery of the products, especially the roadworthy vehicles, comply with the current provisions of the Swiss Road Traffic Act.

Services such as repairs are generally offered by Trotti and only carried out with the customer's consent. The creation of a repair offer is free of charge for the customer.

  1. No guarantee for information

We expressly reserve the right to incorrectly described product properties and prices. Trotti assumes no liability for the correctness, topicality and completeness of the information.

Ancillary agreements must be made in writing to be valid.

  1. Prices

For orders via our Internet shop, the prices offered at the time of the order apply. All prices include the statutory VAT in Switzerland.

For deliveries within Switzerland and the Principality of Liechtenstein, the tariffs of the Swiss Post apply.

We reserve the right to change prices.

  1. Conclusion of the contract (conclusion of business)

5.1 The presentation of the products in the webshop www.trotti.ch and on the brochures does not constitute a legally binding offer, but an invitation to interested parties to place an order.

5.2 If a customer places an order, the incoming order is activated and processed by Trotti. The purchase contract is only concluded when Trotti has accepted the order and confirmed it in writing.

5.3 If Trotti cannot accept an order, the customer will be informed within 3 working days.

In the event of storage bottlenecks, significant delivery delays or unavailability of the ordered product, the customer will be informed by email as soon as possible.

  1. Liability

The electric vehicles delivered by Trotti comply with the provisions of the Swiss Traffic Act at the time of delivery. It is the customer's responsibility to report any malfunctions that could affect road safety to Trotti immediately.

Pay particular attention to the permitted speed of the means of transport delivered by Trotti.

Trotti does not accept any liability for improper or unlawful use of the vehicle.

No claims for damages can be asserted due to damage caused, impossibility of service provision or other faults.

Furthermore, it is expressly pointed out that no liability claims for damage, be it direct or indirect or consequential damage, can be made against Trotti.

  1. Payment

When paying by bank transfer or directly at the post office or bank counter, the order number must be specified as the payment purpose so that the payment can be assigned. Fees are borne by the customer.

In general, the customer undertakes to use the means of payment made available such as bank transfer, Visa- or Master-Card. The products remain the property of Trotti until the purchase price has been paid in full.

  1. delivery

The customer is obliged to check the collected or delivered goods for completeness immediately. The customer must report faulty or incomplete deliveries to Trotti within 5 calendar days.

In order to process the claim, the shipment must be kept in the delivery condition.

  1. Cancellation and termination of the contract

9.1 Orders from Trotti are binding once Trotti has confirmed the order. This means that the customer has to accept the deliveries. In exceptional cases it is entirely up to Trotti to accept subsequent changes or cancellations. Any costs that arise are borne by the customer. The customer will be charged 20% of the order volume as compensation. If the product is no longer in its delivery condition, the loss in value will be offset in addition to the compensation.

9.2 If the customer does not accept the ordered goods no later than 7 days after the first attempt at delivery, Trotti can cancel the contract and offset the compensation mentioned under 9.1.

9.3 If Trotti cannot deliver the order on time due to delivery problems, the customer has the right to withdraw from the contract no earlier than 4 weeks after the agreed delivery date. Any payments made will be refunded by Trotti.

  1. Right of return and exchange

According to the currently valid legislation in Switzerland, the customer does not have the right to change his mind and to return a product after an online purchase.

There is no right of withdrawal for contracts concluded with Swiss companies.

With the order and its acceptance by Trotti, a legally binding contract according to OR Art. 40 ff (binding purchase contract) is entered into.

Claims for compensation due to incorrect images, texts and prices or late delivery are excluded.

  1. Warranty

In principle, the warranty provisions of the manufacturer of the products apply. Trotti rejects any guarantee that is made due to improper handling or manipulation of the delivered product. Vehicles must not be hosed down with a high-pressure cleaner.

All wearing parts are excluded from the guarantee. We grant a 1-year guarantee on lithium-ion batteries and 6 months on lead-acid batteries.

Exchange or repair in the event of a guarantee does not lead to an extension of the guarantee period.

  1. Changes to the terms and conditions

Trotti expressly reserves the right to change these terms and conditions at any time without prior notice.

  1. Applicable Law

In any case, the business relationships between Trotti and its customers are subject to the Swiss Code of Obligations and the Swiss Civil Code (ZGB)

The application of the provisions of the Vienna Sales Convention ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.

  1. Severability

Should individual conditions turn out to be unenforceable, the remaining clauses will not be affected and will remain valid.

  1. Jurisdiction

The place of jurisdiction is the legal domicile of Trotti.ch AG.
